Business Coach Asks the Hard Questions - NYTimes.com

In my last post, Susan Martin, a business coach, pressed Alexandra Mayzler to articulate her vision for her company, Thinking Caps Tutoring. Ms. Mayzler was clear that she wanted to see a ?revolution in education? that elevated the importance of study skills. She was less clear, however, about what role her company might play in this revolution.

Next, Ms. Martin turned to Susan Parker, who owns Bari Jay, which makes and sells bridesmaid and prom dresses. ?My vision is much shorter than Alexandra?s,? Ms. Parker said. ?I just want to have more control over my manufacturing.?

?Let?s take it one step further,? Ms. Martin responded. ?If you had more control, what would that allow you to do??

?To grow the way I want to grow,? Ms. Parker said. ?Right now, I?m so dependent on how many dresses I can get made and where and how that I?m constantly worried.? Last year, she said, Bari Jay grew so quickly that she wondered if its success would lead to its demise. ?If people can?t get the dresses they ordered, they?re not going to want to do business with you,? she said. Things worked out in the end and have improved this year, but looking ahead, Ms. Parker believes manufacturing in Asia, where prices are rising, will become increasingly challenging. ?If you push them too much, either with delivery or price, then you sacrifice on quality,? she said, ?and that?s one thing we?re trying not to do.?

Ms. Parker hired a consultant to help Bari Jay explore other options. ?I?m looking into domestic production again, but I?m still unionized, which makes it difficult,? she said. If Bari Jay manufactures its dresses in the United States, it must use union factories, an expensive proposition. ?On top of that, the U.S. doesn?t really have the skilled workers anymore,? she said. Still, Ms. Parker is speaking with union representatives to see what is possible, and her consultant is trying to find suitable union factories.

Central America, which her consultant suggested, is also under consideration. She asked him to research it, and get back to her. Ms. Parker said someone suggested Bari Jay build its own factory. ?I?m like, O.K., that sounds really expensive and really difficult,? she said. ?But get me information and I?ll look into it.? Ms. Parker feels the issue is in good hands and the process has just begun.

Ms. Martin asked how things would change for Bari Jay if its manufacturing woes disappeared.

Ms. Parker said she envisioned no major changes. She loves Bari Jay?s business model, which focuses on selling through smaller boutiques as opposed to department stores that take a greater chunk of the profit. ?I want to grow, but keep my margins the same,? she said.

In a perfect world,?Ms. Martin asked, how would your role change?

Ms. Parker said it probably wouldn?t change either. As a result of their work with their own business coach (not Ms. Martin), Ms. Parker said she and her sister, a co-owner, were seeing the big picture more and had mostly freed themselves from the compulsion to micromanage their employees. To the extent Ms. Parker keeps a hand in certain day-to-day tasks, she said, ?It?s because I?m a control freak and I like those things.?

Turning to Jessica Johnson, Ms. Martin asked her to share her vision for her company, Johnson Security Bureau.

?My vision is more long-term,? said Ms. Johnson. ?I want to have something that I can pass on to my children ? I don?t have any children yet ? and that they would want to be involved with.?

Like Ms. Parker, Ms. Johnson is pleased with developments at her business and would like to continue growing. ?If we just close the contracts that we?re currently negotiating, we?ll double last year?s sales,? she said. Just as they did from 2010 to 2011.

?Nice job,? said Ms. Mayzler.

But Ms. Johnson isn?t complacent. Because Johnson Security waits 30 to 90 days for payment on various contracts, it is exploring ways to bring in money faster. The company could, for example, offer training, product sales, or consulting services, in addition to traditional security services.

?What?s your biggest challenge?? Ms. Martin asked.

?Talent development,? Ms. Johnson said, without hesitation. Even though the skills required of security guards are very basic, many candidates lack them. Most of her employees have neither high school diplomas, nor G.E.D.s. ?Similar to what Alexandra said, our education system isn?t preparing people to have basic skills,? she said. ?So, we?re expected as employers to train the workforce.?

The security industry is also dogged by low expectations. Ms. Johnson said her customers self select to a degree, but it?s common for companies to balk at paying more than $8-an-hour for security guards. ?If you want someone that is going to be alert, and able to write reports and speak intelligently, you?re going to have to pay that person more,? she said. ?If you don?t want to pay for it, then I?m not going to do business with you. There are 400 other companies you can deal with.?

?What have you done to address these issues so far?? Ms. Martin asked.

?We just try to stay very hands-on with clients, and over-communicate with them,? Ms. Johnson said. She recently visited one who was impressed that she made the effort. No matter how busy she gets, Ms. Johnson said, these visits are important because they help her understand her clients? businesses and let them know she cares. ?They know there?s a difference,? she said. ?For those who aren?t there yet, as my grandmother would say, you just have to keep loving on them until they get it.?

As for her employees, ?It?s a work in progress,? Ms. Johnson said. ?Some will get it and stay with the company and those who don?t will leave ? churn and burn.?

Positioning for the Coming Real Estate Boom ? Realtor.ca Review ...

A number of real estate marketing service companies are preparing for the return of the real estate market. And let?s face it, if they begin preparation now, they will be well positioned to take the market when it returns. ?Zillow, Realestatewebmasters, and Market Leader are 3 companies to look at as the battle of this market shapes up. ?And there are many smaller hosting and marketing companies looking to carve out a niche.

Real Estate Services is one market sector worth a look if you?re an investor looking for the next breakout opportunity.?There are millions of real estate agents in North America, Caribbean, and the UK and their sector is very competitive, yet most agents don?t have the skill or time to do marketing well. Those agents/brokers do their online marketing well stand to dominate their local markets.

3 high profile companies stand out as the lead horses in the race to dominate the real estate marketing service category. ?This category is about helping real estate companies gain visibility online, manage contacts, optimize email and ad campaigns, create leads, and build client loyalty. ?Given that all agents are turning to the web to generate sales leads, those companies that can provide these services are going to be highly valuated in the years ahead.

Zillow, Real Estate Webmasters, and Market Leader are the 3 top contenders to take the realtor service industry. ?Zillow had its high profile IPO launch last year and is now valuated at a billion dollars. ?It shows how a good idea (groupon, linkedin) can take off these days and make investors incredibly rich. Real estate webmasters is another successful company that might make such a move soon too. Market Leader?? recently purchased realestate.com and is purported to now be worth $84 Million. ?One interview with the company?s exec stated the company is losing money yet is still worth 100 to 200 million potentially. Realestate.com is a great property however they?ll need more to compete at the top level.

Zillow, (partnered with Yahoo), recently bought Diverse solutions (powerful idx solutions) to bolster its ability to create leads. The IPO will give Zillow the funds it needs to be a real estate marketing leader. First to market really, since not many companies have established themselves as a leader in real estate marketing services. Most are positioned as real estate agent web hosting companies. The market is fragmented due to the fact that mls associations are themselves fragmented. Zillow, and Yahoo?s Trulia are after the national market in the US, and they?re offering real estate agent advertising services.

Realestatewebmasters is perhaps the largest real estate web hosting company providing a complete content and client contact management system. Each customer is responsible for their own content development and marketing. Realestatewebmasters has some great website solutions (some customers might pay up to $30k setting up their custom site in the first year) however, because it is a system, it presents some limitations for lead conversion (standard programming). Realestatewebmasters doesn?t have agreements with all mls associations across North America.

What Zillow, Market Leader ?, Trulia, Realtor.ca, Realtor.com and other big players in this sector don?t offer to agents, is strategic, original content and dedicated marketing services. Their customers are basically provided with a generic hosting and visibility service. Agents are so desperate for leads however, that they are signing up. An advanced type of service that helps individual agents with content development services and top level SEO and Social Media strategies, will be more attractive. If an agent doesn?t get the leads and sales they need, they are quick to move onto another hosting provider. There?s lots of churn in the real estate hosting business.

Given that the large services can?t deliver the dedicated service and original content targeted for local city markets, there is a niche that can be exploited by dedicated content developers. ?Right now, IDX solutions are all the rage, but with the changes in Google?s search engine algorithm, new, original, engaging and sales converting content will be what everyone is after. The big companies won?t be creating that strategic content for agents.

Conservatives' Trust In Science Has Fallen Dramatically Since Mid-1970s

An anonymous reader writes "While trust in science remained stable among people who self-identified as moderates and liberals in the United States between 1974 and 2010, trust in science fell among self-identified conservatives by more than 25 percent during the same period, according to a study by the University of North Carolina-Chapel Hill. 'Over the last several decades, there's been an effort among those who define themselves as conservatives to clearly identify what it means to be a conservative,' said the study's lead author. 'For whatever reason, this appears to involve opposing science and universities and what is perceived as the "liberal culture." So, self-identified conservatives seem to lump these groups together and rally around the notion that what makes "us" conservatives is that we don't agree with "them."'"

Painkiller Opana, new scourge of rural America

AUSTIN, Indiana (Reuters) - Back in high school in Houston, Texas, C.J. Coomer got good grades and played football. He was dark-haired and handsome, popular with his friends and doted on by his family.

But when his mother got divorced and moved to be near family in rural Scott County, Indiana, Coomer began running with a crowd there that abused prescription painkillers to get high. His weight dropped from 210 pounds to just 140 pounds (64 kg), he couldn't work, and was constantly borrowing money.

One night last July, Coomer tried something new -- Opana, a powerful opioid painkiller containing oxymorphone. He overdosed and died at the age of 24.

"It's a nightmare every single day," said his mother, Melissa Himmelheber, 43, who wiped away tears as she showed pictures of her lost son. "This is a family that was extremely close. Now we're just picking up the shattered pieces."

Prescription drug abuse is the new scourge of rural America. It now leads to more deaths in the United States than heroin and cocaine combined, and rural residents are nearly twice as likely to overdose on pills than people in big cities, according to the Centers for Disease Control.

While methamphetamine addiction has long been associated with small towns, prescription painkillers have overtaken meth as the most abused drugs in places such as southern Indiana, according to local authorities.

Opana is the hot new prescription drug of abuse, sometimes with tragic consequences.

At least nine people have died so far this year from prescription drug overdoses in Scott County, Indiana. Most of the fatalities involved Opana, according to county coroner Kevin Collins.

Before 2011, only about 20 percent of the cases referred to the coroner were overdose deaths, and most of those were suicides rather than accidents. Last year, prescription drug overdoses accounted for 19 deaths, or about half of all deaths referred to the coroner in this county of just 24,000 on the southern tip of Indiana, about 30 miles from Louisville, Kentucky.

"We're seeing a lot of 25-year-olds who are dead for no apparent reason," said Collins, who is so disheartened by the overdoses that it is one reason he won't run for reelection in May.

POTENT, DEADLY

Law enforcement officials are alarmed by the rise of Opana abuse, which they said started after Oxycontin was changed in late 2010 to make that drug more difficult to snort or inject for a heroin-like high. Oxycontin is a brand of oxycodone.

Opana abuse can be deadly because it is more potent, per milligram, than Oxycontin, and users who are not familiar with how strong it is may be vulnerable to overdosing.

Opana, known by such street names as "stop signs," "the O bomb," and "new blues," is crushed and either snorted or injected. Crushing defeats the pill's "extended release" design, releasing the drug all at once.

"This Opana pill has really kicked us in the rear," said Indiana State Police Sergeant Jerry Goodin. "We've never seen an addiction like this."

Oxycontin's new pills make it harder to crush them into a powder as they instead become gummy and cannot be readily snorted or injected. This drove abusers to switch to Opana or to generic, immediate-release forms of oxycodone, according to John Burke, president of the National Association of Drug Diversion Investigators. Drug abuse experts have also found an increase in heroin use.

Endo Pharmaceuticals, which produces Opana, announced in December that it would reformulate Opana. The new pill is being manufactured now.

The new formulation makes it difficult to crush and it turns viscous or "gooey" if an abuser tries to add liquid to it, said company spokesman Kevin Wiggins. When used properly, Opana is indicated for chronic low back and osteoarthritis pain, and cancer pain.

But the old form of Opana is still available, and pharmacy and home robberies are on the rise as addicts search for a way to get their fix, according to police.

"We're pretty much consumed by it," Shane McHenry, a detective with the Dearborn County Sheriff's Department in southern Indiana, said of Opana. He said users who cannot afford Opana sometimes travel to Cincinnati to get heroin, which is cheaper in smaller amounts.

Fort Wayne, Indiana reported about 11 pharmacy robberies related to Opana since Endo announced the reformulation, according to Fort Wayne police spokeswoman Raquel Foster. The thief would hand the pharmacist a note, as in a bank robbery, threatening harm if Opana was not delivered.

MANY SOURCES

The Opana problem has been reported by abuse experts around the country. In Florida, for example, the number of oxymorphone-related deaths rose to 493 in 2010, an increase of 109 percent from the previous year, according to Jim Hall, director of a drug abuse center at Nova Southeastern University in Florida.

Some users and dealers get painkillers from so-called "pill mills" -- storefront pain clinics that sell drugs for cash up front, often to out of-state buyers who take them for resale.

But the other way users get pills is from their doctors, or by buying from seniors looking to supplement a fixed income. One Opana pill brings up to $90 on the street depending on dosage, so it is tempting to sell, said Scott County Sheriff Dan McClain.

A woman in her late 70s was arrested in Austin, Indiana for exchanging pills for work around her house, McClain said.

"Most of what I see is people with a prescription from their doctors and they need the money," said Austin, Indiana Police Detective Lonnie Noble. He said the appetite for Opana is "more aggressive" than it was for Oxycontin.

Nashville, Tennessee Detective Michael Donaldson, who also has seen an increase in Opana abuse, said many small towns have "dirty doctors" willing to give out unneeded prescriptions.

Scott County is one of the poorest areas in Indiana, with a median household income of $39,588 in 2010. It was a hot spot for oxycodone retail distribution in 2010, with 48.79 per capita dosage units -- the highest in the state, according to Lori Croasdell, a coordinator for CEASe of Scott County, a drug abuse prevention group.

A northern section of Austin in Scott County showed signs of poverty and neglect. Run-down trailers and houses with broken windows and peeling paint were mixed in among well-kept homes and tidy gardens.

McClain said the drugs cause a vicious cycle of poverty, since abusers cannot hold a job. "Most of them sleep until noon, get up, and try to find a way to get another pill," said McClain.

One reason for the rise in prescription pill abuse is that Americans feel they can fix any problem - pain, depression, anxiety, hopelessness - with a pill, according to Shane Avery, a Scott County doctor. And some doctors, who may mean well but fear being sued for undertreating pain, give out pills better suited for cancer patients to soothe a backache, Avery said.

"The people who abuse prescription medications know how to doctor shop," said Collins, the Scott County coroner.

Day trading or Investing for the Longterm? | Articles101

Among those who trade stocks there is certainly a continuous debate about whether the most profitable approach to currency markets trading is short or long haul investment. And the two sides rarely reach agreement, because one side is rather conservative in its approach, whereas another features a more radical and freewheeling attitude. Day traders are usually considered the mavericks of the trading world, and they are known for taking gambler?s risks and making huge profits simply speaking levels of time ? sometimes buying and selling the same stock several times in one single day. Those who choose to buy and hold their stocks follow a more risk-averse path, and cite historical trends to back up their claim that their method is really more reliable and is the real shortcut to wealth.

Most investors can enjoy the best of both worlds, by putting aside a number of their money for day trades, and the balance of it for longer-term investment. Because stock investing is often more volatile, and can lead to quick profits or fast losses, most of us would be advised to put only as much of our investment finance as we can comfortably afford to lose, in to this kind of trading strategy. Like that, even although you encounter a worse case scenario, it won?t adversely impact your overall financial situation.

There are pros and cons to both varieties of investing. Those that do day trades take pleasure in the fact that they can enter and from the market quickly, and make money without waiting for the outcome. But any kind of stock market investment strategy requires research into the companies you decide to invest in, and research can take time and energy to do. If you are buying and selling so fast that you don?t have time for you to do sufficient back ground analysis, day trading may not be a prudent approach.

Purchasing companies that provide slow but steady returns is a time-tested approach to the stock market. Actually , most historical evidence supports the idea that should you buy quality stocks and hold them for long periods of time ? at least five years or even more ? you?ll do very well in the stock market. Because of this, those who are young enough to have time on their side may possibly be a good idea to buy some stocks and sock them away for retirement.

With most investments, it is usually better to diversify to minimize risk and maximize potential gains. One good way to accomplish this in the stock market is to employ both strategies, and use a portion of your business growth capital for short-term trades, while leaving yet another portion in long haul investments. If one basket of investments doesn?t do well, the other will probably. And when both do well, you will enjoy twice as much success.

The Guardian launch their own Google TV application in beta

Android Central

Despite not being available yet in the UK, British newspaper The Guardian have gone ahead and developed a Google TV application currently in beta. Naturally it will only be available in the US on Google TV, but as it is accessed through the browser at gtv.guardiannews.com, desktop users can also take a peek.

Seems that The Guardian chose Google TV first because Chrome allows them to build an app quickly, and release new versions frequently. It seems the aim is to use the platform to develop a stable build, then port it to other Smart TV platforms, with an emphasis then on the UK platforms.

The UI looks pretty good, and there is a good range of content on offer in both written and video format. The Guardian are keen for people to test this out, and are listening to feedback to aid them in further development.

(AP) ? Eight people, including a woman celebrating her 26th birthday and six young children at a family slumber party, died Saturday when fire tore through a two-story home while they slept, officials and witnesses said.

A seventh child was on life support after the blaze, the deadliest in West Virginia's capital city in more than 60 years, Charleston Mayor Danny Jones said. The dead children ranged from 18 months to 8.

The cause was under investigation. The fire appeared to have started on the first floor of the home, Charleston Assistant Fire Chief Bob Sharp said. Jones said the home had one working smoke detector on the bottom floor, but it was on a counter and wasn't properly mounted to a ceiling. Another was found in a basement area but didn't work.

A children's picnic table, chairs and an umbrella were overturned in the yard of the home, sitting on a corner in a neighborhood tightly packed with small houses. The outside of the front of the home was blackened by the flames and smoke. Two upstairs windows were shattered and blackened, and what appeared to be an opening for an upstairs air conditioner was stuffed shut with clothes.

Sharp said two of those killed were adults and all of the children who died were younger than 8. Ten people were inside the house at the time of the fire ? about 3:30 a.m.

Jones said Alisha Carter-Camp was among those killed. Neighbors say a family birthday party was held in her honor at the home Friday.

Four of the victims were 3 years old; Jeremiah Camp, Elijah Scott and two children who were only identified by their first name. The others killed included Keahna Camp, 8, Emanuel Jones, 18 months and Alex Seal, an adult whose age wasn't available.

Bryan Timothy Camp, 7, was hospitalized in critical condition. Authorities weren't sure how the victims were all related and how many lived full-time in the home.

"We have reason to believe that a lot of the people stayed in the house more than one night and maybe on a weekly basis," Jones said. "These people may have had residences in other places, but a lot of people lived in this house. They were not just there for that one night."

Roxie Means and her 14-year-old daughter, Cassie, attended a birthday party Friday for Carter-Camp, a hotel worker whose 26th birthday was Saturday. A manager at the Holiday Inn Express Charleston Civic Center said he was told Saturday that Carter-Camp had been killed.

Carter-Camp and her two children were staying with her sister at the home, Roxie Means said.

People started showing up for the party around 2 p.m. Friday and it started outside an hour later with a cookout and toasts to the birthday girl.

"They were nice people drinking a glass of wine," Roxie Means said. "They weren't drunk. They weren't overdoing anything."

Cassie Means said she had gotten to know Carter-Camp and played with her children often. Carter-Camp told her that she was planning to get married in June and move to Pittsburgh to start a new chapter in her life.

"I love the kids," Roxie Means said. "That's really what hurts us."

Cassie Means said she noticed lit candles inside the home when she attended the party Friday night.

And before she left, the children wanted to know if she would be back on Saturday.

"I was telling the kids good night," Cassie Means said. One of the children asked her, "'Cassie, are you coming over to play with us tomorrow?' I said, 'yeah.'"

The child continued, "'you promise me you'll be here tomorrow?'" Cassie Means recalled. "I said, 'I promise you I'll be here when you wake up to play with you. I'll be here right when you wake up."

Hours later, the only adult survivor was smoking a cigarette outside, noticed the fire and came running to Means' home and started "beating down the door," Roxie Means said.

The home was engulfed in flames when firefighters arrived. When they went inside, they immediately came across five victims and "started realizing there were a lot of people in this house, a lot of children."

Jones said he was devastated by the news when he got the call after the fire was reported.

"I was with my children and I just grabbed them and hugged them, because I have a 5-year-old and a 4-year-old," he said. "I walked up there and caught a glimpse of some fatalities and it's something that's hard to grasp. The fact that there are (six) dead children, it's unimaginable."

Rusty Eaton, general manager at the Holiday Inn Express Charleston Civic Center, said Carter-Camp was one of his employees. Eaton said he was notified of her death by her mother Saturday morning.

"Everybody's taking it pretty tough, including myself," Eaton said. "It's a tough thing. It's something you hope you never have to deal with."

He said Carter-Camp had worked at the hotel's front desk for about six months and also helped audit financial paperwork at night. He said that she felt at ease speaking with anyone and that "you didn't have to teach (her) personality."

"She had one of those infectious smiles, never met a stranger. She had personality to spare," Eaton said. "She was great with our customers, great with her co-workers. Certainly, she'll be sorely missed by us."

By midmorning, police had pulled the bodies out. On Saturday afternoon, police searched Carter-Camp's vehicle still parked outside.

"She worked seven days a week, had her kids here," Roxie Means said. "''A really nice girl. I just met her, made friends with her yesterday."

Sharp said it was the deadliest fire in the city since seven firefighters perished in while battling a fire at a Woolworth department store in 1949.

"You can imagine how traumatizing that is to us and shocking to the community in general," he said.

Mexican parties don't meet women candidate quotas

(AP) ? Two of Mexico's three largest political parties have said they have not been able to comply with a legal requirement to reserve 40 percent of their congressional candidacies for women, electoral authorities said Saturday.

The stands by the governing National Action Party, the former ruling Institutional Revolutionary Party and the smaller Green party were the latest chapter in a decade-long struggle to increase women's participation in Mexican politics.

The announcement comes, ironically, as President Felipe Calderon's National Action Party is the country's first major political party to nominate a female candidate for the presidency. Josefina Vazquez Mota is running No. 2 in opinion polls, but generally trails the Institutional Revolutionary Party's candidate by about 10 points.

Leonardo Valdes, the president of Mexico's federal electoral institute, said the three parties had notified him Thursday and Friday that they couldn't meet the requirement.

Valdes said the parties could face "various legal consequences that would affect their participation" in July 1 presidential, senatorial and congressional elections, but did not specify what those consequences might be.

Federal Electoral law says authorities can refuse to register slates of candidates that don't include enough women.

However, the three parties argue that they filled some of their candidacies by primary votes and note that another legal provision exempts candidacies selected in that manner from the gender quota.

Mexico's other large party, the leftist Democratic Revolution Party, appeared ready to comply with the quota.

Mexican parties have struggled to comply with at least the letter of the law since gender requirements were first enacted a decade ago.

Some have been know to run the wives or girlfriends of male politicians for Congress, with the husbands or boyfriends listed as "deputy" or "reserve" replacements should the candidate resign. Upon winning election, the women ? known popularly as "Juanitas" ? promptly resign or take a leave of absence and allow the men to take their seats.

Apple's legal vendetta against Android moves to U.S. without a clear winner so far

SAN FRANCISCO -- Before his death, Apple's (AAPL) Steve Jobs famously promised to go "thermonuclear" against smartphones running Google's (GOOG) Android software, saying they use technology ripped off from the iPhone.

The massive legal attack he launched, now in its third year, didn't destroy Android.

Instead, it's turned into a costly global war

of attrition. In case after case involving dozens of patents, Apple has won small victories that force rivals into temporary retreat by requiring them to remove minor features from their devices. Apple has, in turn, lost some rounds and been forced to rework some of its products.

Two upcoming cases in the United States -- one against Motorola and the other against Samsung -- have the potential to strike deeper blows on either side. The trials involve the legal rights to the core technology behind smartphones and tablet computers and whoever loses could face large damages and increased costs. That could raise prices for consumers.

If Apple wins, Android manufacturers will have to come up with critical fixes or pay Cupertino-based

Apple a hefty fee to keep using its technology, according to several technology and legal analysts. Apple's foes, however, say the iPhone and iPad maker is just as vulnerable to claims it took ideas from other companies. Both Motorola and Samsung have countersued Apple.

At a January court hearing in the Motorola case, the judge suggested that, regardless of the outcome of the trial, neither side is going to achieve total victory.

"You're not going to shut down the smartphone," Chicago U.S. Circuit Judge Richard Posner told Apple's lawyer, according to a transcript. "They're not going to shut down the iPhone."

Apple declined to discuss its patent strategy and has claimed in the past that its competitors "slavishly" copy the iPhone and iPad.

The company has a larger share of the U.S. smartphone market than its rivals, thanks largely to the success of the iPhone 4S. Globally, however, Android devices outsell Apple. Android's global market share was nearly 50 percent, while Apple's iOS software, which runs its mobile devices, had about 19 percent in 2011, according to research firm IDC.

Apple began its global patent fight against Android in March 2010, when it filed complaints against handset-maker HTC Corp in federal court in Delaware and before the U.S. International Trade Commission. Litigation between Apple and Motorola broke out that October and Apple then sued Samsung in April 2011.

The week Apple sued HTC, Jobs told biographer Walter Isaacson he would "spend every penny" of Apple's then $40 billion cash pile on the Android fight.

"I'm going to destroy Android because it's a stolen product," Jobs said. "I'm willing to go thermonuclear war on this."

The company's cash has now grown to nearly $100 billion and Jobs's successor, Tim Cook, said on Monday that Apple would return some of it to investors as a dividend and buy back stock.

Mountain View-based Google supplies Android to the smartphone makers for free, but has not been directly involved in the lawsuits because it does not make its own phone. Its pending acquisition of Motorola, though, will change that.

Among Apple's incremental victories so far is a German court injunction against Motorola over the "slide-to-unlock" feature on smartphones, a signature iPhone maneuver that allows users to access their phones without pressing too many buttons.

Motorola said it implemented a new design for the feature and that the injunction, handed down last month, would not impact the current supply or future sales.

In another example of Apple's success against competitors, Samsung changed the metal frame around the Galaxy Tab after a German court ruled for Apple last September.

Speaking broadly, Samsung spokesman Kevin Kim said in an email the company is confident the litigation will not impact its ability to provide mobile products to consumers.

Yet Apple has also had to change features on its products. Motorola won an injunction in Germany against Apple's iCloud push email function shortly after it lost on the "slide to unlock" feature.

Push email, a widely used technology, automatically informs users about new messages on phones and tablets. Apple played down the impact of the injunction in Germany, saying consumers could adjust their settings so that devices download new email at regular intervals.

When tech companies are forced to rework devices due to patent challenges, the risk is that the changes will annoy consumers and eventually cause them to switch products, said Colleen Chien, an IP professor at Santa Clara University's law school.

Apple's main U.S. case against Motorola, over six of its patents, goes to trial in June before Posner, a renowned federal judge with a keen interest in intellectual property. He wrote an economic analysis of IP law -- one of his dozens of books.

Posner has handed Apple some early victories on how language in Apple's patents will be defined for a jury -- a crucial step in patent litigation. For instance, he adopted Apple's definition of a patent covering how Skype and other streaming video applications operate on smartphones.

A win for Apple on these kinds of patents -- which cover core functions on phones -- would force Motorola to either attempt a difficult technical fix, or to strip out the feature entirely, said Nick Rodelli, a lawyer and adviser to institutional investors for CFRA Research in Maryland.

Apple has said in court papers that a win on core patents would mean a "substantial overhaul" of Android, costing tens if not hundreds of millions of dollars for Motorola.

"That's the game they're playing to win," Rodelli said.

Motorola is asserting three of its own patents against Apple relating to how data is transmitted wirelessly. Those are set for a second trial in June, also before Posner.

"We developed and patented technology 10 years ago in areas Apple is claiming to have invented five years later," said Neill Taylor, Motorola's chief IP counsel.

Taylor added that, if his company wins, Apple has much more to lose due to the volume of iPhone sales.

At the January hearing, Posner said that to win damages, Apple and Motorola would have to show how each patented feature impacted phone sales.

In the other U.S. federal trial, Apple and Samsung are battling over the South Korean company's Galaxy line of smartphones and tablets, which also use Android.

The trial is set for July in San Jose, before U.S. District Judge Lucy Koh, who rejected Apple's attempt last year to get a quick shutdown of Samsung phone and tablet sales during the Christmas holiday. Apple still wants the sales ban and is appealing Koh's ruling.

Apple also has filed a barrage of new claims against Samsung in the California court, while Samsung has countersued. The two companies also have hearings scheduled before the ITC.

The July trial features Apple patents such as one that covers how touch-screen devices discriminate between one finger on the screen, or more, and respond accordingly.

This is a patent that goes to the core of how the devices operate, said David Sunshine, an IP lawyer who advises hedge funds for Cozen O'Conner, a law firm in New York. An Apple win, he said, would be costly for Samsung.

"They haven't hit the holy grail yet," Sunshine said. "But they've had some victories and they're hoping for that big victory."
