NYC Personal Injury Lawyer Comments on the ... - The Daily Legal

NEW YORK, NY, July 30, 2012 -- Attorney Jeffrey Lichtman of Trolman, Glaser & Lichtman in New York City says that the recent tragic death of a 12-year-old boy brings to light how inadequate New York state's wrongful death statutes are when it comes to seeking justice.

According to the New York Times, the boy cut his arm in the school gymnasium while diving for a basketball. Less than three days later, he was dead. What emergency room physicians thought was an upset stomach and dehydration turned out to be sepsis. Hospital records noted that the boy died from severe septic shock brought on by infection.

And, as reported in the New York Times, critical information collected by the hospital during the boy's first visit was never communicated to his parents: weak vital signs and abnormal lab results. The family had no idea just how sick their son was until he ended up in the intensive care unit, three days after he was discharged from the ER.

The family never had time to prepare to say goodbye to their son. And while justice in the courtroom does not even come close to compensating the family for its loss, sometimes the closure provided by holding parties' responsible for their negligence can help families move on. Unfortunately, the laws in New York will not even allow the family to recover for the emotional injury caused by the death of a loved one.

"Tragedies like these occur on a daily basis, yet our antiquated wrongful death laws often do not allow true justice in the courthouse to occur because the emotional distress of the families in these situations is noncompensable in the state of New York," says attorney Lichtman.

For more information about claims of emotional distress and wrongful death lawsuits, contact the personal injury attorneys at Trolman, Glaser & Lichtman by visiting the firm's website at www.tgllaw.com or calling 212-561-5036.

Meet Scott Eide: Health Fitness Specialist Chair | Minnesota School ...

Health Fitness Chair Scott Eide

Scott Eide knows how to sit still. He just prefers not to.

Ever since he can remember, he?s been a running, jumping, biking kind of guy. ?It
didn?t matter if it was football, basketball, tag, two-on-two baseball or bikes,? he says. He and his neighborhood friends were always outside and moving. ?We only had two [TV] channels,? he quips.

Eide has participated in?and pushed his body through??one end of the spectrum to the
other? where sports and fitness activities are concerned. A three sport athlete as a young man, Eide has also competed at the Master?s level in weightlifting?setting a few state records while he was at it?and the Master?s level in track and field. He?s competed in road races and is currently a duathlete (run-bike-run.)

Yet oddly enough, Eide doesn?t consider himself a competitive person. It?s more
about experimentation, he insists. ?Let?s see what my body does when I do this,? is the goal. How far can I reach?

?When you have a bad race,? he adds, ?it?s not about he or she beat me: it?s what
could I have done [differently]?

Eide recognizes that there is an obvious connection between his ?real? life and that
of his chosen profession. But rather than it being a direct causal
relationship, he sees ?one feed off the other.?

As an example, he sites his past work experience. A former strength and track
coach at both SCSU and the College of St. Benedict, Eide began weightlifting because of his students. As a coach he wanted his athletes to be prepared, so he put himself through the training they needed in order to succeed. This, in turn, personally motivated him to compete.

?In my positions,? he comments, ?I?ve always had keys to the weight room. My office
was three steps from the track. As a coach, it?s easy to be motivated.?

In addition, Eide has worked as a cardio-vascular assistant at the St. Cloud
hospital, giving him a medical view of the health and fitness world, and as a trainer at both Gold?s Gym and the YMCA. Choosing different modes of the field keeps him engaged, he says. He is continually educating himself, and this he funnels right back into his classroom.

He also hones his skills by presenting in professional settings, like a recent
appearance at ReJuv Medical in Waite Park. And although he demurs, ?I?m not really a kid person,? Eide volunteers in an after-school program with the University of Minnesota Extension at Bel Clare Acres, a low-income community in the area. He leads exercises and fitness games for disadvantaged children and considers it rewarding. Next up, Eide will volunteer at Rocori High School at an all-day weightlifting competition for area high school athletes.

And by the way, Eide?s influence doesn?t always fall so far from home. This weekend
he will be competing in a duathlon with his 14-year-old son Noah in Buffalo,
Minnesota. It is a race that they won last year.

And after that?who knows? But it?s a safe bet that Eide won?t be caught at home
watching TV.

China surges to top of medals table on Olympics day two

China surged clear at the top of the Olympic medals table on Sunday, adding two more golds to their opening day haul as swimming star James Magnussen put Australia on course for relay glory.

After dominating day one of competition with four gold medals, Chinese athletes hit paydirt once again with wins in shooting for Guo Wenjun before synchronised divers Wu Minxia and He Zi triumphed at the Aquatics Centre.

Guo successfully defended her 10m air pistol title with a thrilling last-shot finish at the Royal Artillery Barracks to overhaul France?s Celine Goberville, who had led going into the last round.

?I just focused on doing my best on the final shot,? Guo said, adding: ?I think everyone is good, I just never give up.?

Legendary diver Wu meanwhile clinched her third consecutive gold medal in the 3m springboard synchronised after wins in 2004 and 2008.

But while China celebrated their burgeoning gold haul, hosts Great Britain were still waiting for their first win with cyclist Lizzie Armitstead having to settle for silver in a thrilling road race won in driving rain by Marianne Vos of the Netherlands.

United States shooter Kim Rhode meanwhile took the gold medal in the women?s skeet, her fifth consecutive visit to the podium following medals at the Atlanta, Sydney, Athens and Beijing Olympics.

Elsewhere Sunday the women?s gymnastics competition was rocked by a failed drugs test, as organisers launched a probe into rows of empty seats at venues.

In the pool, world champion Magnussen ? tipped to be one of the stars of the Games ? dived in at the last change to reel in US veteran Jason Lezak and lift Australia into Sunday night?s relay final as top qualifiers.

It was Magnussen?s first swim at the Games and the ?Missile? delivered on his brash confidence, clocking a sizzling 47.35 seconds to surge past Lezak (48.04).

Defending Olympic champions America were second quickest ahead of Russia and France.

?I felt nice and relaxed in the first 50 and I just let the crowd carry me home at the end,? Magnussen said.

The Americans, who have won eight of the 10 Olympic gold medals awarded in the event, are expected to bring in big guns Nathan Adrian, Cullen Jones and Michael Phelps for Sunday night?s final.

US teenager Missy Franklin, swimming in seven events, was second-quickest.

Uzbek gymnast Luiza Galiulina was provisionally suspended after testing positive for the banned diuretic furosemide, the International Olympic Committee (IOC) announced.

Galiulina underwent a drugs test on July 25, three days before the start of the women?s artistic gymnastics competition.

Meanwhile, the chairman of the London Olympics, Sebastian Coe, insisted most venues were full of spectators as organisers launched a probe into blocks of empty seats at some events.

Sun Yang led the way into the men?s 200m freestyle semi-finals just one day after he gave China it?s first men?s swimming title.

Coe said unoccupied seats at some venues were due to accredited officials still working out which events to attend, but he said he had visited four events on Saturday which were full to capacity.

?Let us put this in perspective. Those venues are stuffed to the gunnels. The public are in there,? Coe said.

?There are tens of thousands of people at this moment within the accredited ?family? that are trying to figure out what their day looks like, where they are going to be asked to go to, frankly working out how you divide your time.?

In other action on Sunday, the United States? collection of NBA multi-millionaires, who are expected to cruise to a successful defence of the basketball title, were facing France in their opening game.

Over at Wimbledon, Maria Sharapova takes on Israel?s Sharar Peer as the women?s tennis first round is completed.

Former world number one Novak Djokovic and home hope Andy Murray, who was knocked out of the doubles on Saturday, are also in action.

A total of 14 medals are up for grabs on Sunday, with two also on offer in judo and weightlifting, as well as one each in fencing and archery.

Neighborhood Transitions & the Local Church: 5 Foundational Steps for Genuine Multicultural Community (part 4 of 4)

So far we've looked at two options churches typically consider when the neighborhood in which they are located goes through change. The first was to to create a true multicultural church. Those options are often the most common, especially relocating, but they also leave out a third scenario which is becoming more common in large metropolitan culture: multilingual neighborhood churches.

I should add that these are broad categories. You could start another campus, relocate part of the congregation, and be a multilingual multisite. Or, you should move to multicultural ministry AND have language congregations as well. You get the point-- these are broad categories.

However, if the community transition is dealing with more distant cultures that speak different languages, an important third response is to create a multilingual church or different congregations meeting in the same buidling (and, better yet, part of the same church).

I once preached at a church in Boston that had five languages represented in the church. They had a multilingual church with different language congregations. In the midst of this, however, they were clearly one, unified church They shared an elder board containing people from each of the congregations who prayed together, worked together, and led together along the way.

I think that the best scenario is not relocation (option 1), though I understand there are times and situations when that it the best thing to do-- and congregations need to listen to the leadership of the Lord. The church is not a building and, if the church has moved far from its building, something has to be done with the building. So, if you relocate, start another church and ministry in the building the Lord gave you.

However, I think multicultural transition is a better choice, either in one multicultural congregation (option 2) or in multiple congregations in one facility or (even better) one church (option 3). With that in mind, let me conclude with some thoughts that are applicable to both options 2 and 3.

Practically speaking, how can this pursuit for a genuine multicultural community in a transitional neighborhood be accomplished? Based on my own limited experience, and more broad experience researching and consulting with churches, I see five foundational steps:

  1. Begin to build leadership reflective of the community. When we were planting our church in Buffalo, our neighborhood was about 40 percent African-American, 30 percent Anglo, and the rest was a mix of other races. We tried to model those percentages in our leadership from the very beginning. The community responded.

  2. Intentionally engage ethnicities present. Multicultural engagement will not happen by accident. A strategic plan should be created. Intentionally seek sufficient knowledge and background about the culture from someone who knows this information.

  3. Move beyond tokenism and give actual representative leadership. Disingenuity will be spotted a mile away. Multicultural leadership must be present across the church: in worship, administration, and teaching to name a few areas.

  4. Consider calling a pastor that is reflective of the predominant ethnicity of the community. Ultimately, it is God's call who to place as pastor, but be intentional, however, to broaden the search to include candidates from a number of different backgrounds.

  5. Reflect the values of the Kingdom of God. Above all else, our church, and the people that make it up, needs to be a picture of Heaven on Earth. Only through God's grace, love, and guidance can this kind of miracle happen. I can't think of too many other images that can better illustrate what Jesus Christ can do in the hearts and minds of people who love Him first and each other second.
Since pursuing a multicultural setting goes against individuals' natural tendencies toward homogeneity, church growth WILL be slower. Nevertheless, when God gives the opportunity to move to multiculturalism, take the risk and make the commitment. When changed lives are the fruit, it's worth it.

In The Public Domain: Available And Free ? For All

While not an official, legal symbol, the copyright symbol with a line through it has become the generally accepted way to indicate that a work is in the public domain. It is usually accompanied by one of the following two statements:

1. This image has been released into the public domain by the copyright holder, its copyright has expired, or it is ineligible for copyright. This applies worldwide.

2. I, the creator of this work, hereby release it into the public domain. This applies worldwide. In case this is not legally possible, I grant anyone the right to use this work for any purpose, without any conditions, unless such conditions are required by law.

When copyright or other intellectual property restrictions expire, works will enter the public domain and may be used by anyone.
More specifically, the public domain comprises the body of knowledge and innovation, especially creative works such as writing, art, music, and inventions, in relation to which no person or other legal entity can
of the common cultural and intellectual heritage of humanity, which in general anyone may use or exploit.

Imagine The Possibilities

Can you imagine having a nearly unlimited, free source of
completed information which you can use to enhance your bright idea?

What if you could simply tap into that source and create
products which you can resell and turn into a
profitable stream of income?
When you know how to tap into the
public domain, all of this is possible.

Works created before the advent of intellectual property laws are part of the public domain. The Bible and Qu?ran, the works of William Shakespeare and Ludwig van Beethoven and the inventions of Archimedes entered the public domain long ago. However, intellectual property rights may exist in translations or new formulations of these works.

In addition, works of the United States government are excluded from copyright law and may therefore be considered to be in the public domain. For example, works created by a U.S. government agency become part of the public domain at the moment of creation. Other examples include: NASA photographs, military journalism, federal court opinions (but not necessarily state court opinions), congressional committee reports, census data, and the U.S. government website. Availability of such documents may, however, be limited by secrecy laws.

In the United States, all copyrights and patents have a finite term; when this term expires, the work or invention is released into the public domain. For example, patents expire 20 years after they are filed. However, a trademark registration may be renewed and remain in force indefinitely provided the trademark is used, but could otherwise become generic. Copyrights are more complex; generally, they expire in all countries when a variety of specific conditions are satisfied.

Before 1978, unpublished works were not covered by the federal copyright act. This does not mean that the works were in the public domain; it means that they were covered under state copyright acts. Websites that claim that ?pre-1923 works are safe? are wrong. These works, now under federal copyright, will not expire for several more decades.

Patents

Publishing the details of an invention before applying for a patent will generally place an invention in the public domain and prevent its subsequent patenting by others. For example, when a chemistry journal publishes a formula, this prevents patenting the formula by anyone. There is an exception to this; however, in U.S. law, the rightful inventor may file a patent claim up to one year after publishing it.

Trade Secrets

If guarded properly, trade secrets never enter the public domain. For example, a business may keep a product formula like that for Coca-Cola a secret indefinitely. However, if it is disclosed to the public, the former secret enters the public domain, although the former secret may still be patented in the United States.

Trademarks

A trademark registration is renewable. A trademark owner may maintain a registration indefinitely by paying renewal fees, using the trademark and defending the registration.

However, a trademark or brand may become a generic term for a particular type of product or service if people do not use it as a trademark (i.e. as a name or graphic representation exclusively identifying that that product or service originates from a particular business).

A genericized trademark ? sometimes known as a generic trade mark, generic descriptor or proprietary eponym ? is a trademark or brand name which has become synonymous with the general or formal term for a particular type of product or service, to the extent that it often replaces this term in colloquial usage.

One famous U.S, example is ?thermos?. An interesting philosophical issue is that a manufacturer who invents an amazing breakthrough product which cannot be succinctly described in plain English (for example, a vacuum-insulated drinking flask) will inevitably find its product described by the trademark (?Thermos?). If the product continues to dominate the market, eventually the trademark will become generic (?thermos?). Other examples are: escalator, trampoline, raisin bran, linoleum, dry ice, shredded wheat, mimeograph, yo-yo, nylon, kerosene, cornflakes, cube steak, lanolin, and high octane, masonite, allen wrench, pabulum, styrofoam, and zipper.

One consequence of a trademark becoming generic is that the exclusive rights which may attach to the use or registration of the trademark can no longer be legally enforced. Genericide typically occurs over a period of time where the trademark owner does not maintain or enforce its proprietary rights (e.g. by using the mark or by pursuing infringement action).
However, genericide is not an inevitable process. In the late 1980s ?Nintendo? was becoming synonymous with home video game consoles but Nintendo was able to reverse this process through marketing campaigns. Xerox was also successful in avoiding its name becoming synonymous with the act of photocopying.

Domain Names

A domain name, which may be bought and sold, never enters public domain. If nobody owns it, it simply doesn?t exist. Top level domains, such as .com, are controlled by the Internet Corporation for Assigned Names and Numbers.

Internet Public Domain Resources

Many people are using the Internet to contribute to the public domain, or make works in the public domain more accessible to more people. For example, Project Gutenberg is coordinating the efforts of people who transcribe works in the public domain into electronic form in order to create e-book. See the Resources section of this newsletter for key links.

33 Cloud Service Providers Join Zerto Cloud Disaster Recovery ...

Ecosystem to Deliver Cloud Disaster Recovery Services Powered by Zerto to Enterprises of All Sizes

BOSTON, MA?(Marketwire -07/23/12)- Zerto today announced that 33 leading Cloud Service Providers (CSP) from around the globe have joined the Zerto Cloud Disaster Recovery Ecosystem (ZCE). Providers in the ecosystem are now able to offer cloud disaster recovery (DR) services in a way that was not possible before, enabling businesses of all sizes to cost-effectively protect production applications both to the cloud and in the cloud.

Businesses are looking to the cloud to provide cost-effective data protection for their production applications. With cloud DR, companies can now replace their primary or secondary data centers and benefit from cloud automation and flexibility while having a solid DR assurance. Until now, cloud-based DR for production applications had been ineffective, complex and cost-prohibitive. Due to limitations with legacy array-based replication, CSPs were required to have exactly the same storage type as their customers, increasing their overall costs. Further driving up costs was the complexity of managing these cloud-based DR offerings, which were inflexible, labor-intensive and difficult to scale. By resolving these problems for CSPs, Zerto makes the cloud itself more resilient, so CSPs can provide enterprise customers with tight SLAs and assurance when placing their most critical business applications in the cloud.

Zerto

?Zerto?s solution has been adopted by cloud service providers because it enables them to offer simple, automated, storage-agnostic DR at an attractive price,? said Ziv Kedem, Zerto CEO and co-founder. ?Recent outages show that until now, customers hoping to use the cloud for disaster recovery had no viable options. The widespread participation in Zerto?s Cloud DR Ecosystem shows that the service provider community is eager to offer DR services that work better with their cloud environments and meet the rigorous standards companies expect of DR services.?

?For our enterprise customers, disaster recovery can be a critical step in the cloud journey,? said Ben Miller, Product Solution Director at Bluelock. ?Before Zerto, a true multi-tenant, cloud-based DR service compatible with Bluelock?s VMware vCloud Datacenter Services was not possible. Writing A Niche Reports Blog For Profit | Assassinati

This news publishing industry generally speaking is not an easy one to get into. Firstly there is a fact that there are already a few really, very big gamers who are very well recognized in the market. And I?m not simply talking about big on the web Mark Nordlicht including the Huffington Post, but enormous multi-national media corporations using newspapers, television channels and all of the rest. So facing it you might think that a small independent publisher has absolutely no chance of making any in streets whatsoever into the forex market. But that is not necessarily true. There is still space for those small independent publishers if you find a great niche and goal it well.

And since information is such a broad community center there are plenty of potential markets which a new copy writer or publisher could choose. This could imply writing about a particular kind of news which you know a lot about, like, for example, publishing marketplace news. Or it could actually mean writing about the fundamental events of the day at a particular perspective ? so if you?re doing that and there is a truly novel standpoint to offer people then you could even forge your own personal niche ? a completely fresh niche created by anyone if you are taking this minute route.
If you are planning on setting up and jogging this kind of site after that probably the most important thing is that you simply really must cover all the big issues which are relevant to your specialized niche. People just will not likely keep coming back to your site in the numbers that you?re going to want to see if you?ll find big holes in your coverage ? even if the composing which you do release is super premium quality and super helpful and entertaining.
1 solution to this, if you?re an lone writer and don?t feel that you have the time for you to cover absolutely anything yourself, is to retain the services of freelance writers. There are plenty of sites where you can hire the self employed pretty cheaply on-line, although you will have to take care to pick the right people or perhaps you may end up with cheap work. If you do not need to pay out the money for other writers then another solution is to publish short summaries of a narrative and then provide hyperlinks to further information. Ten or fifteen minutes may be all it takes to do a little bit of study, pull together the principle facts of the report in question, and one or perhaps two quality articles to recommend. Obviously you can also solicit additions from your readers, that is not always a reliable supply of content.
But the primary thing is that you have to appear unique from the beginning. That means you must set across an unique characteristic about your site within the design, layout, vague ideal and title, and not just rely an unique writing style for the articles themselves.
Another important point this that Mark Nordlicht is very time vulnerable. What I mean by that is the fact when a news story pauses it pays off hugely to publish something immediately. And you can even get further than that. If you know your niche well you can publish stories along with rumours of what may happen or predictions of your personal, and that way you might already have relevant written content about any given tale even before it breaks ? which will give you a big boost when it comes to traffic generation for the story ahead of bigger sites who cover a larger range of topics and could therefore not have this niche expertise to determine the story coming.

Syrian regime?s thugs face retribution

Every war has its demons. The chaos of bullets and bombs gives rise to a certain breed of men who join the fight for the thrill of killing. In Syria these monsters who are the enforcers for President Bashar Assad?s regime are called the ?shabiha." If Assad's regime falls they could face retribution. Kirstie Alley slapped with class-action lawsuit over weight-loss ...

Kirstie Alley has been hit with a lawsuit over her weight loss claims.

When she ?Fat Actress?? star, whose weight has fluctuated dramatically through the years,? dropped 100 pounds around the time of her 2011 appearance on ?Dancing With the Stars,?? she credited the weight-loss product Organic Liaison ? which she? endorses ? for helping shed the pounds. However, a California woman, who? used the product, is now suing the actress, claiming Alley is lying? about the way in which she lost the weight, stating it was the? 61-year-old?s rigorous dancing regime, not the supplement, which helped? her get slim.

In the lawsuit filed in Los Angeles Superior Court, Marina Abramyan says? Alley?s Organic Liaison Weight Loss Program makes ?false and misleading? advertising claims that [the program] can cause significant weight? loss.? The legal filing specifically calls out the claim on the? company?s website that quotes Alley as saying, ?I am proof of its? success, I lost one hundred pounds on Organic Liaison? and ?I can assure? you that if you follow this program, you?ll get healthier, lose weight,? and not be ?annoyingly? hungry.?

Abramyan, who says she ?did not experience any of the benefits? Defendants advertised,? calls Organic Liaison ?nothing more than? run-of-the-mill fiber and calcium supplements.? The suit also notes that? ?Alley?s weight loss is not due to the Organic Liaison Program, but? rather, is the result of an above average exercise regimen and extremely? low calorie diet, including her time on the television program ?Dancing? With the Stars? (?DWTS?), where she spent five to seven hours a day? exercising as part of the competition.?

The displeased dieter (and any other Organic Liaison users who want to? join in on the class-action suit) is asking that the company be? prohibited from making its allegedly false claims and seeks monetary? damages.

When contacted by Yahoo! TV for comment, Organic Liaison called the claims in the lawsuit ?patently false? and vowed to ?vigorously defend ourselves against these frivolous claims.? Read the company?s full statement below.

?

Since her days on ?Cheers,?? Alley has been candid about her weight struggle, even capitalizing on? it by starring in the TV series ?Fat Actress.? However, in 2004, she? became tired of her constant weight struggle (and nasty tabloid stories)? and signed on as the celebrity spokesperson for Jenny Craig. Although? she quickly dropped 75 pounds, three years later she regained much of? the weight and stepped down from her role with the company. By 2009, she? was up to 230 pounds when she underwent yet another diet overhaul,? switching to an all organic diet and following Organic Liaison, which is? a combination of supplements and things like journaling about weight? loss. On ?The View? in June 2011 following her stint on ?DWTS,? she? detailed the specifics of her weight loss, saying, ?I lost 60 pounds? before I started ?Dancing With the Stars,? and I lost 30 pounds during? it.? By that September, her total weight loss total was 100 pounds when? the size 6 star told People: ?I feel back to normal. I have my game again.?

Nearly a year later, Alley appears to have kept most of the weight off? this time around. During an appearance at the 2012 Book Expo America in? New York City, she looked trim in a black wrap dress with a pink motif.

As for Organic Liaison, this isn?t the first time the company has come? under fire. In 2010, critics linked the weight-loss program to? Scientology ? fellow Scientologist Kelly Preston also endorses the? product ? connecting it to a Scientology plan called the purification? rundown, which is a controversial detoxification program developed by? Scientology?s founder L. Ron Hubbard. When asked about the connection on? the ?Today? show, Alley snapped, ?Well it?s such bullsh-t ? can I say? that?? And Alley added that she is ?way too cheap? to share any of the? company?s profits with the church.

A rep for Organic Liaison issued the following statement to Yahoo! TV: ?The claims against Ms. Alley and Organic Liaison are patently false.

?Ms. Alley began her weight loss on the Organic Liaison program in early 2010. Ms. Alley had lost about 70 pounds prior to her participation as a contestant on ?DWTS? in the Spring of 2011. That loss of weight was documented in Ms. Alley?s numerous appearances during that time frame on talk shows, numerous magazine articles, and on QVC. Subsequently, during the nearly 3 month period that Ms. Alley competed on ?DWTS,? she lost approximately another 20 pounds.

?Ms. Alley did not reach the 100 pound weight loss milestone on the Organic Liaison program until months after her participation in ?DWTS? had ended. As such, contrary to Abramyan?s assertion, it was not several hours a day of vigorous dancing related to ?DWTS? that caused her weight loss; it was her studious adherence to the Organic Liaison Weight Loss Program that caused the loss; that Program contains and requires regular exercise for success. As just mentioned, the Organic Liaison program expressly includes, as a fitness plan, regular, daily exercise as part of its weight-loss program. Organic Liaison even provides consumers with a ?calories burned? chart to track the amount of calories they are burning through regular exercise. Organic Liaison?s website promotes rigorous daily exercise such as jumping rope and dancing.

?Ms. Alley participated in ?DWTS? for only a short period of time during her approximately 1 1/2 year participation in the Organic Liaison program; the vast majority of her weight loss had nothing to do with her participation in that show. It is Ms. Alley?s persistence over 1 1/2 years on the Organic Liaison program, coupled with regular exercise, that lead to her dramatic weight loss over that time period; this is consistent with Organic Liaison?s advertising and representations, none of which create false net impressions to the reasonable consumer. Ms. Alley?s dramatic weight loss occurred because she stuck with the Program during the entire relevant time frame, losing 1 to 2 pounds per week, which is approximately the rate of loss recommended by the Program for healthy, long term weight loss.

?Organic Liaison is an advanced weight loss system with products which, when taken as directed, do exactly as advertised ? help users to lose weight.? Rescue Me aids weight loss through an advance formula of over 32 high quality ingredients which reduces cravings for food and appetite.? In addition, Organic Liaison products such as Release Me prevent muscle soreness in order to promote regular exercise, necessary to success of the Program, while Organic Liaison?s Relieve Me supports colon cleansing, which aids weight loss, prevents fluid retention and bloating. Further, Nightingale, the all-natural liquid formula sleep aide which contains ingredients which enhance relaxation and sleep, while helping to reduce carbohydrate cravings and alleviate muscle pains. Thousands of users have successfully lost weight and made healthy lifestyle changes by following the Organic Liaison program.

?We will vigorously defend ourselves against these frivolous claims.?

How to Demand (and Get!) Great Customer Service ? Experimental ...

My family recently replaced our windows replaced. It was an ordeal that turned out to be long and expensive. When the company installed windows that weren?t even the right color, I had to make several angry phone calls to the general manager and owner to get the problem solved. And along the way, I learned a few valuable lessons about customer service.

Gone are the days when airline passengers could expect a warm meal or department store customers knew that managers would go out of their way to make the shopping experience pleasant. Spending money today can be a real chore because most companies have lost an emphasis on customer service. It isn?t just the companies? fault?it?s our fault, too, for paying more attention to price-tags than the quality of the things we buy and the way we?re treated when we buy them.

It?s harder to get great customer service today, but that doesn?t mean we should give up trying. Not only do we get more value for our hard-earned money, but we also push companies to make their stores better places to work and shop.

Next time you run into a customer service dilemma, here for demanding that businesses treat you as a valued customer:

  • Be willing to pay for good customer service. When you?re budgeting, don?t just focus on price. Think instead about value. Your money pays not only for the product, but for the experience of buying and using it, hopefully for many years to come.
  • Shop local.?Using vendors that depend on the business of every customer is another way to avoid customer service fiascos. Even when they arise, local companies are more likely to go out of their way to earn your business back.
  • Shop with companies with a good reputation for customer service. By shopping with companies that treat customers right, you?re less likely to have problems to begin with. Use a service like Angie?s List or Yelp and ask for friends? and neighbors? reviews. When you have to use a big company, defer to one with a solid customer service rep like Apple, Disney, Hilton hotels, Southwest Airlines, or Zappos.com.
  • Use a credit card company known for taking the customer?s side. When a purchase goes wrong, you don?t have to fight alone. Buying something on a credit card that believes the customer is always right means you?ll always have someone else on your side. Adam and I have had great success with our American Express card.
  • Expect good customer service from the get-go. My family has learned the hard way that companies that start out with bad customer service usually don?t get any better. When something goes wrong early in a transaction, don?t make apologies or excuses for the company. Give them a chance to fix it if you like, but be prepared to find another vendor if they let you down again.
  • When you need to make a complaint, wait until you can do it calmly. In many cases, the employee listening to your complaint isn?t the one who caused a problem. By waiting until you?re calm, you avoid taking out your anger on someone who doesn?t deserve it. And you?re more likely to get what you want if you can speak rationally and in a level tone of voice.
  • Always start out pleasant. It really is true that you catch more flies with honey than with vinegar. Sometimes customer service complaints must get heated, but you can resolve many issues with a polite phone call or e-mail.
  • Make specific complaints and offer specific solutions. When you make a complaint, tell the person to whom you are speaking exactly what went wrong and exactly how you would like him or her to fix it. Not, ?This food is terrible,? but, ?My steak is cold and my mashed potatoes are over-salted. I would like you to prepare me another meal.? Not only do you sound more convincing, but you?re making it easier for the company to make things right.
  • Be clear about the consequences for the business. You don?t have to threaten a company to let them know you mean business. A simple line like, ?I?m a loyal customer, but sorry I won?t be able to do business with you anymore? or ?I?ll have to tell my neighbors not to do business with your company? often does the trick.
  • If necessary, send your complaint up. Even though more and more employees are refusing to refer complaints up to their managers, managers and owners are in a much better position to solve your problem. Ask for a manager. If you?re refused, ask for the manager?s direct line or e-mail address. When you can?t get in touch with a manager?or the manager doesn?t propose a satisfactory resolution?never be afraid to call or write an owner or C.E.O. Write down the name of everyone you speak to about your complaint as you move up the corporate ladder.
  • Be willing to compromise. When you propose a solution, stick to reasonable demands and be prepared for some give and take as you negotiate with the company. For example, a hotel may not be able to give you a free room because your neighbors were loud?but do expect them to give you a discount or offer you a free breakfast.
  • Know when to walk away. Certain fights just aren?t worth the effort. Time is money, so before you bunker down for a long, drawn out conflict, decide whether the payoff is going to be worth the time you will spend arguing. Sometimes it is, but when it?s not, shake the dust from your feet and find somewhere else to do business.
  • Give credit where credit is due.?When you get great customer service?or when someone finally solves a customer service problem for you in a way that makes you happy?be sure to thank the person who is responsible, in writing if possible. There is no better way to encourage employees to focus on customer service than to reward them with your sincere gratitude for treating you right.

Have you ever had to fight with a company over a purchase you?ve made? How did you handle it? Let us know in the comments.

Researchers at Bielefeld University questioned schoolchildren on cyberbullying attacks through the Internet and by mobile phone

This press release is available in German.

Embarrassing personal photos and videos circulating in the Internet: researchers at Bielefeld University have discovered that young people who fall victim to cyberbullying or cyber harassment suffer most when fellow pupils make them objects of ridicule by distributing photographic material. According to an online survey published on Thursday 19 July, about half of the victims feel very stressed or severely stressed by this type of behaviour. 1,881 schoolchildren living in Germany took part in the survey conducted by the Institute for Interdisciplinary Research on Conflict and Violence (IKG) and commented on their experiences with cyberbullying as a victim, offender or witness.

Cyberbullying is the term used for attacks by one or more persons through the Internet or by mobile phone - where Facebook or an instant messenger, for instance, are used to denigrate or humiliate someone or harm their social relationships. A weaker person is the target of repeated and intentional attacks. For social scientists Dr Peter Sitzer, Julia Marth and their team, the purpose of the study is to describe the different aspects of this phenomenon.

One focal point of the online survey was the degree of stress felt by the victim related to the various forms of cyberbullying. The survey discovered that those affected find some forms of cyberbullying more stressful than others. For instance, more than half of the victims considered the posting of personal photos and videos stressful if it was aimed at humiliating them or making them the object of ridicule. The researchers put these findings down to the fact that the impact of this form of cyberbullying is difficult to control; digital photos and videos can often be duplicated and distributed any number of times and thus made available to a potentially unlimited audience. In contrast, derisive, insulting, abusive and threatening behaviour was perceived as very stressful or severely stressful only by about a quarter of the respondents. "This might be because this form of cyberbullying can be aimed directly at the victim. In this case, there are relatively few witnesses," says Peter Sitzer. Another possibility is that the adolescents consider such attacks as normal, everyday behaviour among their peers.

The scientists also questioned the victims about the forms of cyberbullying they had experienced. Attacks through the Internet or by mobile phone, where they had been subjected to derision, insult, abuse or threats were reported especially frequently by the victims questioned. In many instances, the victims also claimed that rumours had been spread about them or hateful comments made. Schoolgirls among the victims claimed comparatively often that they had been the subject of cyberstalking and that, against their will, someone had wanted to talk to them about sex. Very little or no previous knowledge of the victim is required for these acts. Only very seldom did the victims questioned report deeds requiring additional knowledge. "It's easy to send someone offensive messages by e-mail or instant messenger or post them on their wall, for example in Facebook," says Sitzer. "But for a bully to be able to pass on private messages or confidential information to third parties in order to humiliate or ridicule the victim, he must have knowledge of such messages or information."

The anonymous survey also gave the offenders of cyberbullying an opportunity to speak. They stated how they had attacked their victims in the Internet or by mobile phone. The offenders questioned reported most frequently that they had ridiculed, insulted, abused or threatened others. Defamatory behaviour and cyberstalking also received a frequent mention. While reports of being excluded from a group in the Internet were comparatively seldom among the victims, this form of cyberbullying was indicated frequently by the offenders. According to the researchers, one explanation for the discrepancy between the statements given by the victims and offenders could be that the victims often did not notice they had been excluded from a group. "Disparagements, however, are only hurtful when the victim perceives them as humiliating," says Peter Sitzer. He presumes that there is a similar reason behind the fact that more offenders claimed to have forwarded personal photos and videos of others to third parties than was actually reported by victims. This is because in order to humiliate or ridicule a victim, it is not necessary for the victim to learn that embarrassing photos of him are being circulated.

"Our findings underline that cyberbullying is not a trivial matter but a serious problem which demands preventive countermeasures," says Peter Sitzer. It is the task of parents, educationalists and teachers to teach schoolchildren how to behave in a socially responsible manner towards other users. At the same time, it is important that firm action be taken in cases of cyberbullying. More than half the offenders surveyed said that their attacks had not resulted in any negative consequences for them. However, the offenders also need help to change and refrain from making the attacks. In addition, the researchers point out that the victims of cyberbullying must be taken seriously and need help to overcome these experiences and return to an everyday life worth living.

Sheep, a dog and GPS tracking reveal evolutionary rules behind sociality

How does a Venus flytrap know when to snap shut? Can it actually feel an insect?s tiny, spindly legs? And how do cherry blossoms know when to bloom? Can they...

Sheep may come across as simple, straightforward followers. But as those who work with the animals know, sheep can behave in surprising ways. For one, flocking may not show a friendly tendency?there might be selfish motivations as well.

In research published on July 24 in the print edition of Current Biology, scientists monitoring sheep have demonstrated empirical support for a behavioral theory first proposed almost 40 years ago. "We're getting to the nitty-gritty of the real evolutionary rules selected for in behavior," says behavioral ecologist Andrew King of the University of London Royal Veterinary College, a co-author on the study. King has studied sociality in birds, fish, baboons and even humans?and believes these rules of group behavior found in sheep could apply more broadly. "If we can understand how these rules work, we can hint at similar systems and common principles across species."

Selfish-herd theory, first proposed by the British evolutionary biologist W. D. Hamilton in 1973, posits that individuals dilute their risk of predation by moving into a larger group?a "Don't eat me, eat this other guy!" response. Although widely cited, the theory is difficult to test in the field given the unpredictable nature of predators and challenge of observing movements in a large group of animals.

The interactions between sheep and sheepdog, however, provide an ideal testing ground. "Working with sheep is great because you can measure their movements and even tell the dog when to begin," King says. "You have control of the whole system but it remains really natural as well."

King?with colleagues at the University of London and University of Cambridge?outfitted 46 sheep with GPS backpacks to enable second-by-second remote tracking. They then orchestrated a predator event by releasing an Australian Kelpie, a sheepdog that also wore a GPS module, on the flock. In each of three trials, the approaching dog drove the sheep in a fleecy flurry while scientists recorded how each individual in the group moved.

In each trial, the sheep ran rapidly toward the center, jostling for position within the group, as selfish-herd theory would predict. To further suss out the rules behind the sheep's movements, the biologists compared the observed behavior with various mathematically modeled scenarios. As they report in Current Biology, one of the patterns they noted relates to the kind of predator behavior that triggers a sheep's flight. Whereas one hypothesis suggests an individual will start running when a predator is within a given distance, the researchers found instead that sheep won't start moving until the dog has approached a relative midpoint of neighboring sheep. The finding suggests that sheep have some level of social-spatial awareness, possibly because they do not want their herd scattered.

This particular predator?prey model may have a few confounding elements, however, particularly because the sheepdog has no intention of eating the sheep and the latter may be familiar with the dog's approach. Nevertheless, the authors found the response of the sheep to be so consistent that they believe it makes for a reliable representation of predator?prey interaction.

"How individuals move relative to one another within groups to avoid predation has remained an intriguing yet vexing field of research," says behavioral ecologist M. Justin O'Riain at the University of Cape Town in South Africa. O'Riain, who has studied how seals move into more compact groups when a shark approaches, notes that the innovative use of GPS technology in the study by King and colleagues takes these questions to "a new and exciting level."
